3. Refund & Cancellation Policy

All digital product sales are final.

No refunds will be issued for digital downloads, online programs, or memberships.

3a. Online Purchase Agreement

By purchasing any product, program, or service through this Website or affiliated platforms, you acknowledge and agree that:

You are entering into a legally binding contract with THCG, LLC.
You agree to abide by these Terms & Conditions, the Refund Policy, Licensing Terms, and Privacy Policy.
Checking a box or clicking “Complete Purchase” constitutes your digital signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Uniform Electronic Transactions Act (UETA).
You agree that all sales are final unless otherwise stated in writing.
You may not initiate chargebacks without first contacting THCG, LLC to resolve any dispute. Your receipt and confirmation email serve as evidence of this contractual agreement.

4. Intellectual Property & Licensing

All digital programs, content, and resources provided by THCG, LLC are licensed—not sold. Purchase grants you a limited, non-transferable, single-user license to access content within the THCG platform.

You may not reproduce, copy, distribute, download, alter, translate, train AI models on, or sublicense our content.
You may not store or redistribute any program, video, document, image, file, or course material outside of our authorized delivery systems.
Your license will be automatically revoked upon any violation.
THCG, LLC retains full ownership of all content and intellectual property.
You agree not to falsely represent ownership of or affiliation with THCG programs or content.

5. Podcast Protection – Health Coach Conversations

“Health Coach Conversations” is a proprietary podcast of THCG, LLC and is protected by copyright, trademark, and common law rights.

Unauthorized use of our podcast name, logo, brand assets, audio clips, or content is strictly prohibited.
You may not create derivative works, quote audio out of context, or suggest endorsement without express written consent.

6. Platform Use Rules

Key Platform Usage Rules:

All access must occur through THCG-managed platforms.
Downloading, screen-recording, reverse engineering, AI ingestion, or API access is strictly prohibited.
No modules, files, or program parts may be made publicly available.
You agree not to share, sublicense, lease, or otherwise allow others to access your account.
Unlocked, shared, or redistributed files will result in access termination and potential legal action.

6a. THCG Full Program Library – BETA Terms

By enrolling in the THCG Full Program Library – BETA Program (“Program”), you (“Participant”) agree to the following terms, which are governed by the general Terms & Conditions and licensing structure of THCG, LLC.

1. Program Access & Usage

Participants will receive access to over $70,000 worth of THCG programs for one (1) year from the date of enrollment.
New programs valued at $10,000–$20,000 may be added at THCG’s discretion during the subscription term.
Program content will be delivered exclusively through THCG-managed platforms. No external hosting, duplication, or download of complete programs, modules, or files is allowed.

2. Client Enrollment & Delivery

Participants may enroll up to 1,500 clients per license within their subscription term.
Programs may only be delivered through THCG’s proprietary platform. Any delivery outside of this environment is prohibited.

3. Pricing & Grandfathered Rate

The enrollment fee is defined at the time of initial BETA purchase and is valid for one year.
Participants who remain in good standing will be “grandfathered” at their original rate, subject to continued adherence.
Once the BETA phase ends, standard program rates will increase for new participants.

4. Membership Mastery Course

Participants receive complimentary access to the Membership Mastery Course (valued at $2,497) during active membership.
This course is licensed for personal educational use only and may not be resold, duplicated, or redistributed.

5. Platform & Support

Participants must use the THCG-managed platform to deliver content.
Basic technical support will be provided; business coaching is not included.

6. Refunds & Cancellations

All sales are final. No refunds will be issued due to the digital nature of the content.
Non-compliance with these terms may result in the revocation of access without refund.

7. Intellectual Property Rights

All content remains the sole intellectual property of THCG, LLC.
Any duplication, extraction, sharing, or storage outside the THCG platform is a material breach and may result in legal action.

8. Termination & Compliance

THCG reserves the right to revoke access without notice for violations of any BETA or General Terms.
Terms may be updated, and participants will be notified of significant changes.

9. Acceptance of Terms

By enrolling, you confirm that you have read, understand, and agree to these Program Terms and the overarching THCG General Terms & Conditions.

8. Fees, Payments & Interest

Payment Plans & Recurring Billing

If you elect to purchase a program, course, or service from THCG, LLC using a payment plan or recurring billing option, you agree to the following:

Authorization: By selecting a payment plan, you authorize THCG, LLC to charge your chosen payment method in the amount and frequency stated at the time of purchase.
No Cancellation for Partial Payments: You are responsible for completing all payments in your plan. Canceling your payment method or failing to complete scheduled payments does not relieve you of your financial obligation.
Default Consequences: If a payment fails or is more than 15 days late, THCG, LLC reserves the right to revoke access to programs and/or assess a late fee of $30.
Access Suspension: Access to all purchased digital content may be suspended until your account is brought current.
Chargebacks & Disputes: Any chargebacks or payment disputes initiated without prior contact and reasonable opportunity to resolve will result in immediate termination of access and may be referred to a collections agency, along with applicable fees.
Collections: Accounts referred to collections may incur a $50 processing fee and will be subject to the maximum interest rate allowed by law, as specified below.

9. Security & Data Practices

THCG, LLC uses commercially reasonable efforts to secure your information both online and offline.
We cannot guarantee that unauthorized breaches will never occur.
Users are advised to use strong passwords and log out after each session.
Breach notifications will be provided via email or public notice within a reasonable time as required by law.

10. Children’s Privacy

This website is intended for users 18 years or older.
THCG, LLC does not knowingly collect personal data from children under 18.
If we learn that a child has submitted information, we will delete it immediately.

11. Acceptable Use Policy

You may not:

Use our content for illegal, unethical, defamatory, or misleading business practices.
Resell, scrape, replicate, or create derivative works based on THCG programs.
Harass, stalk, or exploit THCG clients, team, or community members.
Introduce viruses, Trojans, or exploit security vulnerabilities on the platform. Violations may result in permanent access termination and legal prosecution.

12. Termination & Indemnification

THCG may revoke access to services at any time for violation of these terms.
Termination does not entitle you to a refund.
You agree to indemnify and hold THCG, LLC harmless from any claims, losses, or damages resulting from your use of the services or breach of this agreement.
Indemnity extends to misuse of the platform by your employees, contractors, or clients.

13. Assignment & Severability

You may not assign your rights under this agreement without written consent.
If any part of this agreement is held invalid or unenforceable, the remaining parts shall remain in effect.
Failure to enforce any provision shall not be deemed a waiver of future enforcement.

13A. Right to Modify Terms Without Notice

THCG reserves the right to modify these Terms & Conditions, program rules, or platform policies at any time, with or without notice.
Significant changes may be posted or emailed, but are not guaranteed.
Retroactive changes may apply to comply with the law, protect THCG IP, or enhance user protection.

14. Governing Law

The laws of the State of Florida govern this Agreement.

If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.

These terms shall be governed and interpreted under the laws of the State of Florida.
Jurisdiction for all disputes shall lie exclusively in Martin County, Florida.
Any legal action must be brought within one (1) year of the cause of action.

15. Testimonial Use and User Submission

You grant THCG, LLC a worldwide, perpetual, irrevocable license to use any testimonials, comments, photos, or videos you submit.
This may include your name, image, business name, and statements for marketing and education.
Submissions become the property of THCG, LLC. Removal requests may be considered, but are not guaranteed.
